A JURISIDIÇÃO CONSTITUCIONAL NAS TEORIAS DE JUSTIÇA DE RAWLS E DWORKIN / THE JUDICIAL REVIEW IN THE THEORIES OF JUSTICE OF RAWLS AND DWORKIN (p.60)

Resumo

O artigo investiga duas teorias políticas nas quais a questão da justiça é tema central: o liberalismo de Jonh Rawls e Ronald Dworkin. A proposição destes autores é reconciliar o direito à moral sem recorrer a justificações metafísicas. Desta forma, o fundamento de valor de uma comunidade é revelado por meio de um procedimento construtivo e racional, estabelecido em bases normativas cognoscíveis implícitas na cultura política da sociedade. Para Rawls e Dworkin a jurisdição constitucional é instância referencial de justiça no arranjo institucional democrático, pois promove a leitura moral da constituição e decide com base em argumentos de princípios. Em oposição, critica-se a prevalência da jurisdição constitucional em detrimento do princípio democrático. Ao fim, discorre-se sobre o modelo constitucional dualista, admitido por Rawls na sua obra “Liberalismo Político”, em referência a Bruce Arckman. A metodologia utilizada foi bibliográfica e jurisprudencial, pura, qualitativa, descritiva e exploratória.

Abstract: This article investigates two political theories about justice: the liberalism by Jonh Rawls and Ronald Dworkin. The proposal is reconciliation of law and morality without metaphysical justification. Therefore, the reason of community is from a racional constructive established and accepted on normative bases implicit in the political culture of society. To Rawls and Dworkin the judicial review is reference in the democratic institutions because doing a moral reading of the constitucion and deciding with argument of principles. In opposiciont, criticized the prevalence of judicial review on detriment of the democratic principle. At the end, talks about the dualist constitucional model accepted by Rawls in his book “Political Liberalism”, in referring to Bruce Arckman. The methodology used in the research its literature and jurisdiction, it’s also pure, qualitative, descriptive and exploratory
