Resumo

Este trabalho discute em que medida é possível afirmar que os tribunais podem ser considerados representantes do povo, ainda que sejam compostos por membros não eleitos. Para isso, aborda a relação existente entre eleição e os conceitos de representação de Hanna Pitkin para identificar a possibilidade de existir representação sem eleição e accountability em um governo democrático.

Abstract: This paper aims to discuss whether is possible to declare that the courts can be representatives of the people, even they are consisting by unelected members. To achieve this end, this article address the relationship between election and Hanna Pitkin's representation concepts to ascertain if there is representation without election and accountability in a democratic government.
