Resumo

Resumo: O objetivo do presente artigo é reconhecer o valor jurídico do direito ao desenvolvimento no plano internacional e constitucional à luz da interpretação sistêmica prohomine, que fundamenta a hermenêutica emancipatória dos direitos humanos, e da cláusula de abertura material dos direitos fundamentais prevista no art. 5°, §2º da Constituição Federal de 1988. Ao reconhecer esse direito como um direito humano e fundamental, resta saber quais são os efeitos e impactos dessa proteção jurídica na ordem internacional e nacional. Dessa forma, busca-se provocar a percepção do direito ao desenvolvimento de forma contextual, enquanto expressão de um fenômeno jurídico complexo que invoca a necessidade de percepção de outros fenômenos sociais e humanos que interagem com esse direito de modo a ser considerado um ‘direito plataforma’ para o exercício de outros direitos.

Abstract:The aim of this paper is to recognize the legal status of the human right to development in the constitutional and international level across a systemic interpretation pro homine underlying the emancipatory hermeneutics of human rights and the opening materials clause of fundamental rights provided in the art. 5 °, paragraph 2° of the Constitution of 1988. By recognizing this right as a human right from the application of an emancipatory hermeneutics, which remains to highlight the effects and impacts of such legal protection in the international and national order. Through the literature and law it seeks to bring the realization of the human right to development in a contextual way, as an expression of a complex legal phenomenon which calls for an awareness of other social and human phenomenon, in order to be considered a 'platform' for the exercise of other rights.
