Resumo

Resumo: Os direitos humanos e os direitos fundamentais, compreendidos os primeiros, como direitos positivados na ordem internacional e, os segundos, como direitos positivados em constituições nacionais, mantêm semelhanças na proteção de conformação e promoção da dignidade humana, como sujeito de direito individual ou plural (coletivo de direitos). Neste sentido, os direitos humanos e os direitos fundamentais são os únicos grandes discursos pós II Grande Guerra, cuja percepção das suas existências é objetiva e sensível pela comunidade internacional.

Abstract: Human rights and fundamental rights, understood the first, as positivized rights in the international order and, the second, as positivized rights in state constitutions, keep similarities in conformation protection and promotion of human dignity, as a subject of individual or plural right (colective rights). In this sense, human rights and fundamental rights are the only great speech post  II Grand War,  whose perception of their existence is objective and appreciable by the international community.
