Resumo: Este trabalho destina-se ao estudo do superendividamento no Direito brasileiro. Analisa-se os instrumentos de tutela existentes e as mudanças do Projeto de Lei (nº 283), pela Comissão de Juristas do Senado Federal no ano de 2012, o qual ainda aguarda aprovação.

Abstract: This Paper aimes to study of over-indebtedness on Brazilian Law. Were analysed the existing instruments and the changes proposed by the Law Project n. 283 from the Committee of Jurists of the Federal Senate, in the year of 2012, which is still waiting for approval.
