Resumo

RESUMO: Este trabalho apresenta a análise do caso de AdelirGoés através do estudo da Teoria de Direito como Integridade de Ronald Dworkin e Teoria Sistêmica de NiklasLuhmann, discutidos nas obras O Império do Direito e Sociologia do Direito II, respectivamente. Enfocando o direito da mulher, seguem considerações acerca da possibilidade de escolha na forma do parto, assim como a interferência do Estado na liberdade de escolha dos indivíduos. O objetivo principal do estudo é responder se a autonomia e dignidade da mulher foram realmente violadas.

Abstract: This article analysis the case of AdelirGoés through the study of the Law as Integrity from Ronald Dworkin and NiklasLuhmann’s Systemic Theory, discussed in the works The Empire of Law and Sociology of Law II, respectively. Focusing on womens’s rights, remarks were made about the possibility of choice in the form of labor, as well as the interference from the State in the freedom of choice for individuals. The main objective of the study is to answer if the woman’s autonomy and dignity were actually violated.
