Resumo

Resumo: O mundo em que vivemos mantém-se em constante evolução. O homem alcançou conhecimentos no campo da Biotecnologia que lhe permitem o mapeamento genético dos seres vivos, viabilizando sua completa individualização. Conhece-se do estabelecimento de bancos de dados genéticos humanos e muito se ouve falar das ilimitadas possibilidades que as informações neles armazenadas ocasionam. Percebe-se que os dados genéticos podem estar atrelados a relações entre particulares, e que por sua vez estão diretamente relacionados para com os direitos mais íntimos dos seres humanos. Pretendendo-se no presente estudo, através do método monográfico-bibliográfico, tomando como referencial teórico os estudos de Ingo Wolfgang Sarlet, estabelecer o debate sobre a eficácia dos direitos fundamentais nas relações entre particulares atinentes aos dados genéticos humanos, objetivando-se defender o estabelecimento de uma eficácia direta prima facie.

Abstract: The world we live in keeps evolving. Man has achieved expertise in the field of biotechnology that allow to mapping genes of living beings, enabling its complete individualization. Speak up of the establishment of human genetic data bancs, and much is said about the unlimited possibilities that the information stored may cause. It is perceived that genetic data can be linked to relations between individuals, and that in turn are directly related to the most intimate rights of human beings. Intending it, this study, through monographic-bibliographical method, taking as its theoretical framework studies Ingo Wolfgang Sarlet, introduce a debate on the effectiveness of fundamental rights in relations between individuals relating to human genetic data, aiming to defend the establishment of a direct prima facie efficacy.
