KATÉCHON: O DIREITO ENTRE O SACRIFÍCIO E O PERDÃO / KATECHON: THE RIGHT BETWEEN THE SACRIFICE AND FORGIVENESS (P.58)

Resumo

Resumo: O autor analisa a desmistificação da ideia de “justiça” no campo penal, defendendo que, após a revelação da inocência das vítimas persecutórias promovida pelo Evangelho e o abandono da “ética da retribuição” (própria das sociedades mítico-sacrificiais), ocorreu uma lenta transformação no direito dos países “ocidentais”, que passaram não mais a perseguir o “justo”, mas sim a pretender a racionalização da violência comunitária por meio de procedimentos previsíveis. Para isso faz uma pequena introdução à estrutura dos mitos fundadores, bem como trata da transição entre a “teologia da retribuição” e a “teologia do perdão” e da fusão de ambas na construção do Direito penal moderno como mal menor (Katéchon).

Abstract: The author analyzes the demystifying of the "justice" in the criminal area, arguing that after the innocence of persecution victim’s  revelation promoted by the Gospel and the abandonment of the "ethics of retribution" (itself the mythical-sacrificial companies), there was a slow transformation on the right of "Western" countries, which are now no longer pursuing the "fair", but rather want the rationalization of community violence through predictable procedures. For this is a short introduction to the structure of the founding myths, and deals with the transition from the "theology of retribution" and "theology of forgiveness" and fusion of both in construction of modern criminal law as a lesser evil (katechon).
